Terms & Conditions
These Terms and Conditions govern your use of the Phithak website and the engagement of our pension protection legal services. Please take a moment to read them at your own pace. If you have questions, we are happy to explain any section.

1. Definitions
In these Terms, the following words carry specific meanings:
- "Phithak", "We", "Us", "Our" — Phithak, a legal practice registered in Thailand, with offices at 64 Asok Montri Road, Watthana, Bangkok 10110.
- "Service" — any legal service or consultation provided by Phithak, including Pension Safeguard Consultation, Protective Correspondence, and Sustained Legal Care.
- "Client", "You", "Your" — any individual who contacts, engages, or accesses the Phithak website or services.
- "Website" — the website located at phithak.live and any associated pages.
- "Agreement" — these Terms and Conditions, together with any engagement letter or written instruction accepted by Phithak.
- "Content" — all text, documents, materials, and information published on the Website.
2. Acceptance of Terms
By using our Website or engaging our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please refrain from using our Website or Services.
Our Services are intended for individuals aged 18 and over who have the legal capacity to enter into a contract. By engaging us, you confirm that you meet this requirement.
Nothing in these Terms is intended to be alarming or difficult to navigate. If any section is unclear, please contact us and we will explain it in plain language.
3. Services Description
Phithak provides pension protection legal services in Thailand, currently offered in English. Our principal services are:
- Pension Safeguard Consultation (฿3,800) — a careful meeting to understand your concerns and explain your pension entitlements.
- Protective Correspondence (฿5,900) — preparation of formal letters and submissions to protect your pension position.
- Sustained Legal Care (฿7,900) — ongoing representation through a pension matter, including documentation, submissions, and proceedings.
Services are provided at our Bangkok office or remotely where appropriate. Availability may be subject to our current capacity and the nature of your matter. We will let you know honestly if a particular service is not suited to your circumstances.
4. Client Responsibilities
To allow us to assist you effectively, we ask that you:
- Provide accurate, complete, and timely information relevant to your matter
- Inform us promptly of any changes to your circumstances or contact details
- Respond to our requests for instructions within a reasonable timeframe
- Not use our Website or Services for any unlawful purpose
- Not attempt to misrepresent your situation in a way that could affect the advice or services we provide
We rely on the information you provide to act in your best interest. The quality of our service is directly linked to the completeness of what you share with us.
5. Intellectual Property
All content on the Phithak Website — including text, design elements, and documents — is the property of Phithak or its licensors and is protected by applicable Thai and international intellectual property laws.
You may view and print content for your personal, non-commercial use. You may not reproduce, distribute, or use Website content commercially without our written permission. Documents prepared specifically for your matter remain your property upon payment and are shared under a limited, personal-use licence.
6. Payment Terms
Our fees are quoted in Thai Baht (฿). Payment arrangements are confirmed in the engagement letter provided before work begins. Unless otherwise agreed:
- Consultation fees are payable prior to or at the time of the consultation
- Correspondence and sustained representation fees may be structured as a deposit with the balance due upon completion, as set out in the engagement letter
- We accept bank transfer and cash payment at our offices
Refunds. If you need to cancel a booked consultation with more than 24 hours' notice, we will arrange a full refund. Cancellations with less notice may be subject to a cancellation fee, which we will explain in advance. For correspondence and representation services, fees paid for work already completed are not refundable, but we will always discuss any concerns about your matter with you openly.
We do not add hidden charges. Any disbursements (such as court or filing fees) will be clearly discussed with you before being incurred.
7. Service-Specific Terms
The scope of each service engagement is set out in a written engagement letter provided to you before we begin. This letter confirms what we will do, the estimated timeframe, and the fee. Changes to the agreed scope should be requested in writing and may affect the timeline and cost.
Confidentiality. All information shared with us in connection with your matter is treated as strictly confidential. We will not disclose it to any third party without your consent, except where required by law or professional obligation.
We aim to keep you informed at each stage and will not take significant steps in your matter without your instructions.
8. Disclaimers
The content on our Website is provided for general information only and does not constitute legal advice for your specific circumstances. Each situation is different, and you should not rely on Website content as a substitute for a personal consultation with one of our lawyers.
We make reasonable efforts to keep Website content current and accurate, but we cannot warrant that it is free from errors or reflects the very latest legal developments. If you have a time-sensitive matter, please contact us directly.
9. Limitation of Liability
To the extent permitted by Thai law, Phithak's liability for any claim arising from the provision of Services is limited to the fees paid by you for the specific service giving rise to the claim.
We are not liable for indirect, consequential, or unforeseen losses arising from your use of our Website or Services, or for events outside our reasonable control (force majeure), including disruption to courts, government agencies, or communication systems.
Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence.
10. Indemnification
You agree to indemnify Phithak against any claims, losses, or costs arising from your breach of these Terms or from your use of our Services in a manner inconsistent with any instructions or warnings we have provided.
11. Termination
Either party may end a service engagement by giving reasonable written notice. If you wish to conclude a matter before completion, we ask that you let us know as soon as possible so we can handle the transition carefully.
Phithak reserves the right to end an engagement if continuing would conflict with our professional obligations, if instructions given are unlawful, or if fees remain unpaid without reasonable explanation. We will always communicate such a decision to you directly and with appropriate notice. Provisions relating to confidentiality, intellectual property, and payment survive the end of the Agreement.
12. Dispute Resolution
These Terms are governed by the laws of the Kingdom of Thailand. If a concern arises, we encourage you to contact us in the first instance at [email protected] so that we can try to resolve the matter informally and quickly.
If informal resolution is not possible, any dispute shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand. You retain the right to approach relevant regulatory or professional bodies.
13. General Provisions
- Entire Agreement. These Terms, together with any engagement letter, constitute the full agreement between us relating to the subject matter described.
- Severability. If any provision is found unenforceable, the remaining provisions continue in full force.
- Waiver. Failure by either party to enforce a right does not constitute a waiver of that right in future.
- Assignment. You may not transfer your rights or obligations under these Terms without our prior written consent.
- Notices. Formal notices should be sent to [email protected] or by post to our registered address.
14. Changes to Terms
We may update these Terms to reflect changes in our services or applicable law. When we do, the updated version will be published on this page with a revised effective date. For clients with ongoing engagements, we will give reasonable advance notice of any material changes. Continued use of our Website after an update constitutes acceptance of the revised Terms.
